Mobile Terms and Conditions

These Mobile Terms & Conditions (the “SMS Terms”) govern your enrollment in and use of the text-message program offered by the AFC Scholarship Fund and the American Federation for Children Growth Fund (together, “AFC SF,” “we,” “us,” or “our”), both 501(c)(3) nonprofit organizations. By enrolling in the SMS program, you agree to these SMS Terms. These SMS Terms supplement, and should be read together with, our Website Terms of Use and Privacy Policy, which are incorporated herein by reference. Except as expressly provided herein, the Website Terms of Use apply to your participation in the SMS program.
1. About Our SMS Program
We send recurring SMS and MMS messages to individuals who opt in through a form on afcscholarshipfund.org. Messages may include information regarding the Education Freedom Tax Credit (EFTC), school choice news, fundraising communications, program updates, surveys, and other content related to our mission. Messages may be sent using an automated system. Message frequency varies. Message and data rates may apply.
2. How to Opt In (Double Opt-In)
To enroll, submit your mobile number through an opt-in form on afcscholarshipfund.org and then confirm your subscription by replying to the one-time confirmation text we send (for example, by replying YES). You will not receive recurring messages until you confirm. By enrolling, you represent that you are at least 18 years old and are the account holder for the mobile number provided or have the account holder’s permission, and you consent to receive recurring automated text messages from us at the number you provide. Consent to receive text messages is not a condition of making a donation or receiving any services from AFC SF.
3. How to Opt Out
You may cancel at any time by texting “STOP” to the number from which you received our messages. After you send “STOP,” we will send a final confirmation message, and you will no longer receive messages from us unless you re-enroll. To re-enroll, sign up again through an opt-in form on afcscholarshipfund.org.
4. Help
If you need help, text “HELP” to the number from which you received our messages, and we will respond with information about the program and how to unsubscribe. For additional support, email [email protected].
5. Message & Data Rates
Message and data rates may apply to messages sent to or received from us, and message frequency varies. If you have questions about your text or data plan, contact your wireless carrier. We are not responsible for charges from your wireless carrier.
6. Carrier Support
We support messaging to major U.S. wireless carriers. Supported carriers may change at any time without notice. Wireless carriers are not liable for delayed or undelivered messages, and neither we nor our carriers are liable for delayed or undelivered messages, and we are not responsible for delayed or undelivered messages.
7. Nature of Communications
Our SMS and MMS communications are intended to support our mission and may include informational, program-related, survey, and fundraising communications. Nothing in our messages constitutes legal, tax, or financial advice, and you should consult a qualified professional before making decisions based on them.
8. Privacy
We respect your privacy. We will not sell your mobile number or the information we collect through our SMS program to unaffiliated third parties for their own marketing purposes. We share this information only with our affiliated entities and service providers who help us operate the SMS program (such as our messaging provider), with our advertising platforms, as otherwise described in our Privacy Policy, or as required by law. Please review our Privacy Policy for additional information regarding our collection, use, and disclosure of personal information.
9. Limitation of Liability
We, together with our respective officers, directors, employees, agents, and service providers (collectively, the “Releasees”), shall not be liable for any damages of any kind arising out of or relating to your use of, or inability to use, our SMS program, including, without limitation, damages caused by errors, omissions, interruptions, defects, delays in transmission, computer viruses, or service failure. To the fullest extent permitted by law, the Releasees shall not be liable for any indirect, special, incidental, punitive, exemplary, or consequential damages, including any loss of data or profits, even if advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above may not apply to you. In any event, our total aggregate liability to you arising out of or relating to the SMS program or these SMS Terms shall not exceed ten dollars ($10.00).
10. Changes to These Terms
We reserve the right to update or modify these SMS Terms at any time. Changes will be posted to afcscholarshipfund.org with a revised Effective Date. Your continued participation in our SMS program after changes are posted constitutes acceptance of the updated SMS Terms.
