This website (the “Site”) is owned and operated by AFC Scholarship Fund (“AFC SF,” “we,” “our,” or “us”). The following terms and conditions of use (the “Terms of Use”) govern your access to and use of the Site, including any information, resources, application materials, donation tools, contact forms, and other services made available through the Site. All pages within the Site and any information, material, or content made available on or through the Site are subject to these Terms of Use.

Your use of the Site indicates your agreement to be bound by these Terms of Use. These Terms of Use apply only to your use of the Site and do not apply to any other third-party website. To the extent that there is any conflict between these Terms of Use and any separate agreement governing a scholarship, donation, grant, application, or other program administered by AFC SF, the terms of that separate agreement or program will govern with respect to that program.

If you opt in to receive text messages, your participation in that program is governed by our separate Mobile Terms & Conditions. Those terms describe how to opt in and out, message frequency, and message-and-data-rate disclosures, and they control over these Terms with respect to the SMS program.

If you do not agree to the Terms of Use, we kindly ask you do not access or use the Site.

Intended Use

The Site is intended for general informational use regarding scholarship programs, educational opportunities, charitable giving, tax credit programs, and related topics.  Information provided on the Site is offered solely as a convenience and general resource to visitors.

The Site is not intended to provide legal, tax, accounting, financial, investment, or other professional advice. Any information provided through the Site regarding scholarship programs, tax credits, eligibility requirements, deadlines, donations, schools, educational programs, or related matters may change without notice and may not reflect the most current information available. Any estimates, calculations, projections, or similar tools made available through the Site are provided for informational purposes only and should not be relied upon as a substitute for professional advice.  

Nothing contained on the Site constitutes a guarantee of eligibility for, acceptance into, receipt of, or continuation of any scholarship, grant, tax credit, donation program, or other benefit. Any scholarship, donation, tax credit, or program administered by AFC SF may be subject to separate eligibility requirements, application procedures, deadlines, terms, and conditions.

Individuals under the age of 18 should use the Site with the involvement, supervision, or consent of a parent or legal guardian.

Donations

Donations made through the Site are processed by FundraiseUp, our third-party donation platform, with payments handled by Stripe. By making a donation, you authorize the charge to your selected payment method and represent that you are authorized to use it. Recurring donations continue until you cancel them as described at the time of sign-up or by contacting us.

Where you designate a donations to a particular fund, school, or program, we will use reasonable efforts to honor your designation, subject to our discretion and applicable legal and tax requirements. We are a ) tax-exempt organization described in Section 501(c)(3) of the Internal Revenue Code of 1986, as amended (the “Code”), and a scholarship granting organization under Code Section 25F(c)(5) Eligible contributions are intended to (i) qualify for a dollar-for-dollar tax credit up to $1,700 per taxpayer per year and (ii) be tax-deductible, with respect to the amount of any contributions in excess of $1,700, subject to applicable law and program requirements. No goods or services are provided in exchange, except as disclosed at the time of the gift.

If you believe a donation was made in error, contact us at the information provided below within 30 days, and we will work with you in good faith to resolve it.

Changes to the Terms of Use or Site

AFC SF reserves the right to change, modify, or discontinue the Site or any portion of the Site, including any and all content, information, scholarship program descriptions, eligibility information, educational resources, and other materials available through the Site, at any time, without notice to you.  AFC SF reserves the right to modify or amend these Terms of Use at any time. All changes will be effective immediately upon their posting on the Site. If we make a material change to these Terms of Use, we may provide notice of such changes through the Site. By accessing or using the Site after any changes to these Terms of Use, you agree to all such changes.

Your Use of the Site

You are granted a limited, non-exclusive, revocable right to access and use the Site solely for personal or general informational use. This right does not include the right to and you shall not (nor shall you facilitate, direct or assist a third party to):

  • Modify, reproduce, distribute, republish, sell, or otherwise commercially exploit any part of the Site or its content, except as expressly permitted by AFC SF;
  • Access, tamper with, or use non-public areas of the Site or AFC SF’s computer systems;
  • Probe, scan, or test the vulnerability of any system or network or breach or circumvent any security or authentication measures used by the Site;
  • Use any robot, spider, scraper, data mining tool, or other automated means to access, collect, extract, harvest, or otherwise obtain information or content from the Site;
  • Interfere with or disrupt, or attempt to interfere with or disrupt, the operation, security, or functionality of the Site or any user’s access to the Site;
  • Submit false, misleading, fraudulent, or inaccurate information through any form, application, inquiry, donation, contact, or other submission process made available through the Site;
  • Use the Site or its content in any manner other than the manner in which it is intended to be used without AFC SF’s prior written consent; or
  • Use the Site or its content for any purpose prohibited by applicable law.

Except for the limited right expressly granted to you in these Terms of Use, AFC SF and its licensors expressly reserve all rights and licenses relating to the Site and its contents.

Termination / Suspension

You agree that AFC SF may suspend, restrict, or terminate your right to access or use all or any part of the Site at any time and in AFC SF’s sole discretion, including if AFC SF believes that your use of the Site violates these Terms of Use, applicable law, or may be harmful to AFC SF, the Site, or any other person or entity.

Privacy

By accessing and using the Site, you agree to the terms of AFC SF’s Website Privacy Policy (“Privacy Policy”), which is incorporated into these Terms of Use by reference. Please review the Privacy Policy carefully to understand how AFC SF collects, uses, stores, and discloses information obtained through the Site. By using the Site, you acknowledge and agree that AFC SF may collect, use, and disclose your information as described in the Privacy Policy.

Information Disclaimer

The information on the Site is available to you solely for general informational purposes. While we attempt to keep the information on the Site accurate and current, you should independently verify information on the Site for accuracy and usefulness for your particular needs. We disclaim any implied warranty or representation regarding the accuracy, completeness, or appropriateness of information available through the Site.

You assume full responsibility for your use of information available through the Site. You understand and agree that AFC SF is not responsible or liable for any claim, loss, or damage resulting from reliance on information available through the Site.

Nothing contained on the Site constitutes a guarantee of eligibility for, acceptance into, receipt of, or continuation of any scholarship, tax credit, grant, donation program, or other opportunity described on the Site. Eligibility requirements, application procedures, deadlines, funding availability, and program requirements may change and should be independently verified.

Any calculator, estimator, or similar tool made available through the Site is provided solely for informational and educational purposes. AFC SF does not guarantee the accuracy of any estimate or result generated by such tools. The mention of specific products, services, schools, organizations, or programs on the Site does not constitute a recommendation or endorsement by AFC SF.

Trademarks, Copyright, and Other Proprietary Rights

AFC SF, or third parties from whom AFC SF has permission, own the trademarks and service marks that are used on the Site. All proprietary content and materials on the Site including, without limitation, the Site’s layout, organization, design, and any graphics, text, icons, audio, video, and the like are protected by copyrights, trademarks, service marks, trade secrets, and other proprietary rights and laws. All rights are reserved by AFC SF and said third parties, and no implied rights are granted to you or any third parties. These and other graphics, logos, service marks, trademarks, and trade dress of AFC SF and its licensors may not be used without prior written consent of AFC SF or its licensor, as the case may be. Without limiting the foregoing, no AFC SF trademark or trade dress may be used in connection with any product or service that is not AFC SF’s, in any manner that is likely to cause confusion among users, or in any manner that disparages or discredits AFC SF. You agree to comply with all applicable laws by not copying or using this proprietary content, except as allowed by these Terms of Use or by written consent of the owner of the proprietary rights.

You grant AFC SF a perpetual, royalty-free, irrevocable, sub-licensable, assignable, and transferable license to any feedback, submissions, ideas, concepts, know-how, or techniques that you submit to the Site or otherwise choose to share with AFC SF through other communication channels for any purpose (including without limitation commercialization) and without compensation to you, subject only to AFC SF’s Privacy Policy.

Children’s Privacy

The Site is not intended for use by children under the age of 13. AFC SF does not knowingly collect personal information directly from children under the age of 13 without appropriate parental consent. If AFC SF becomes aware that personal information has been collected from a child under the age of 13 in a manner inconsistent with applicable law, AFC SF will take reasonable steps to delete such information. The Site may contain links to other unrelated websites on the Internet. AFC SF is not responsible for and has no obligation to review the content, accuracy, copyright compliance, decency standards, or other materials on such websites. These Terms of Use do not apply to such unrelated websites and you should review the privacy policy and terms of use for any such website that you visit. AFC SF makes no representations or warranties regarding the security of any information you make available to such websites. AFC SF is not liable for any losses or damages incurred as the result of your business dealings with such third parties.

Disclaimer of Warranties

THE SITE, INCLUDING ANY CONTENT PROVIDED THROUGH THE SITE, MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. AFC SF MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE SITE OR CONTENT CONTAINED ON THE SITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL SUCH CONTENT ON THE SITE ARE PROVIDED “AS IS” WITHOUT WARRANTY OR CONDITION OF ANY KIND, EITHER EXPRESS OR IMPLIED. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AFC SF, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR THE LOSS OF USE OR REPLACEMENT OF DATA, OR LOST PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THE SITE OR ANY OF ITS CONTENT WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF AFC SF OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THESE TERMS OF USE, TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFC SF’S AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100). ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS OF USE MUST BE BROUGHT WITHIN ONE (1) YEAR AFTER THE CLAIM ARISES OR SUCH CLAIM SHALL BE FOREVER BARRED, UNLESS A LONGER PERIOD IS REQUIRED BY APPLICABLE LAW.

SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES OR WARRANTIES. ACCORDINGLY, SOME OF THE EXCLUSIONS AND LIMITATIONS ABOVE MAY NOT APPLY.

Indemnification

You agree to indemnify, defend, and hold harmless AFC SF, its affiliates, directors, officers, employees, representatives, consultants, service providers, and agents from any and all losses, expenses, third-party claims, liabilities, damages, and costs (including, without limitation, attorneys’ fees) arising from or related to: your use of the Site; your use of any material, information, data obtained from the Site; your breach of these Terms of Use; or your infringement of any intellectual property or other right of AFC SF or any other person or entity.

Notice

AFC SF may deliver notice to you by means of email, a general notice on the Site, or by other reliable method to the address you have provided to AFC SF.

Interpretation and Disputes

These Terms of Use are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute, claim, or controversy arising out of or relating to these Terms of Use or the Site shall be brought exclusively in the state or federal courts located in Texas, and you consent to the jurisdiction and venue of such courts.

TO THE FULLEST EXTENT PERMITTED BY LAW, EACH PARTY WAIVES ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE SITE.

Any claim arising out of or relating to the Site or these Terms of Use must be brought within one (1) year after the claim arises, unless a longer period is required by applicable law.

Entire Agreement

These Terms of Use and AFC SF’s Privacy Policy constitute the entire agreement between you and AFC SF governing your use of the Site, and supersede all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. Notwithstanding the foregoing, certain programs, scholarship opportunities, donation programs, application processes, or services accessible through the Site may be subject to separate terms, conditions, eligibility requirements, or program rules. Any waiver of any provision of these Terms of Use will be effective only if in writing and signed by AFC SF. These Terms of Use will inure to the benefit of AFC SF’s successors and assigns. If any provision of these Terms of Use is determined to be unlawful, invalid, or unenforceable, such provision shall be enforced to the maximum extent permitted by law and the remaining provisions shall remain in full force and effect.

Electronic Communications

You acknowledge that these Terms of Use are a valid and binding agreement. To the fullest extent permitted by law, you agree that these Terms of Use and any other documentation, agreements, notices, or communications between you and AFC SF may be provided to you electronically. Please print a copy of all such documentation, agreements, notices, or other communications for your reference.
