These SMS Terms of Service (“Terms”) govern your opt-in to receive text message communications from AFC Scholarship Fund and the American Federation for Children Growth Fund (collectively, “we,” “us,” or “our”), both 501(c)(3) nonprofit organizations. By submitting your mobile number through any opt-in form on afcscholarshipfund.org, you agree to these Terms.
1. About Our SMS Program
AFC Scholarship Fund and the American Federation for Children Growth Fund send SMS and MMS messages to individuals who have opted in via a web form on afcscholarshipfund.org. Messages may include education about the Education Freedom Tax Credit (EFTC), school choice policy news, program updates, and other content related to our mission of expanding access to quality K-12 education for American families. You may receive messages from an automated system. Message frequency may vary.
2. How to Opt In
You may opt in to receive SMS and MMS messages from AFC Scholarship Fund and the American Federation for Children Growth Fund by submitting your mobile phone number through an opt-in form on afcscholarshipfund.org. By submitting your number, you confirm that you are the account holder or have the account holder’s permission, and that you consent to receive recurring text messages from both organizations at the number provided.
3. How to Opt Out
You can cancel the SMS service at any time. Text “STOP” to the number from which you received our messages. After we receive your STOP request, we will send you a final confirmation SMS and you will no longer receive messages from us. If you wish to re-enroll, you may sign up again through any opt-in form on afcscholarshipfund.org.
4. Help
If at any time you forget what keywords are supported, just text “HELP” for help. After you send the SMS message “HELP” to us, we will respond with instructions on how to use our service as well as how to unsubscribe. For Service support or assistance, text “HELP” or email [email protected].
5. Message & Data Rates
Message and data rates may apply for all messages sent to or received from AFC Scholarship Fund. If you have questions about your text or data plan, contact your wireless carrier. AFC Scholarship Fund is not responsible for any charges incurred through your wireless carrier.
6. Carrier Support
AFC Scholarship Fund is able to deliver messages to the following mobile carriers: AT&T, Verizon Wireless, T-Mobile, Sprint, MetroPCS, U.S. Cellular, Alltel, Boost Mobile, Nextel, and Virgin Mobile. Supported carriers are subject to change.
AFC Scholarship Fund and its carriers are not liable for delayed or undelivered messages.
7. Nature of Communications
AFC Scholarship Fund and the American Federation for Children Growth Fund are educational nonprofit organizations. SMS and MMS communications from afcscholarshipfund.org are informational and educational in nature. Nothing in these messages constitutes legal, tax, or financial advice. Any future solicitation activity will be governed by updated Terms posted to afcscholarshipfund.org.
8. Privacy
AFC Scholarship Fund and the American Federation for Children Growth Fund are committed to protecting the privacy of our users. Your mobile number and any information collected through our SMS and MMS program will not be sold, rented, or shared with third parties for their own marketing purposes unless required by law. 9. Limitation of Liability
AFC Scholarship Fund and the American Federation for Children Growth Fund, together with their respective officers, directors, employees, agents, and service providers (collectively, the “Releasees”), shall not be liable for any damages of any kind arising out of or relating to your use of, or inability to use, our SMS and MMS program. This includes, without limitation, damages caused by errors, omissions, interruptions, defects, delays in transmission, computer viruses, or service failure. Releasees shall not be liable for any indirect, special, incidental, punitive, exemplary, or consequential damages, including any loss of data or profits, even if advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above may not apply to you. In any event, our total liability to you shall not exceed ten dollars ($10.00).
10. Changes to These Terms
AFC Scholarship Fund reserves the right to update or modify these Terms at any time. Changes will be posted to afcscholarshipfund.org with a revised effective date. Your continued participation in our SMS program after changes are posted constitutes acceptance of the updated Terms.
